Terms and Conditions: Vailes Heating & Air’s 3rd Annual Scary Furnace Giveaway

1. Giveaway Overview:
One contestant will be eligible to win a Trane Single-Stage 80% or 95+% efficient forced air Natural Gas or Propane Furnace (up to 120K BTU) with a Trane XR724 Thermostat, valued up to $6,100. The prize includes delivery and installation. The exact value depends on the size of the home and the location of the current furnace. If the furnace is located in an unconditioned area, Vailes will select an equivalent product of similar value.

2. Eligibility:
The furnace must be installed in a residential property that is safe, healthy, and provides easy access to the existing furnace. Only gas or propane furnaces qualify. All other heating systems, such as boilers, heat pumps, wood stoves, oil furnaces, and floor furnaces, are excluded. The winner must be a homeowner within a 20-mile radius of the Vailes office located at 2247 Jefferson Hwy. Fishersville, VA. Proof of homeownership is required. Rental properties, commercial buildings, and new construction are ineligible. Vailes’ employees, their immediate family members, and affiliated companies cannot participate. “Immediate family members” refers to spouses, parents, in-laws, children, siblings, and other extended family members.

3. Nomination Period:
The nomination period runs from October 1st, 2024, at 12:00 AM to October 27th, 2024, at 11:59 PM. Nominations must be submitted through the form on the Vailes website. Only one nomination per person, household, and email address is permitted. Multiple nominations for the same person, or household, or using different email addresses will result in the disqualification of all entries.

4. Nomination Process:
Nominations can be submitted by anyone, including self-nominations, with valid contact details for both the nominator and the nominee. Incomplete submissions will not be considered. After the nomination period ends, Vailes will review all entries as a team to determine the top 3 nominees based on need and eligibility.

5. Prize Details:
The prize value is based on replacing existing equipment under typical conditions, utilizing the current chimney and vent pipes. It does not cover asbestos abatement, chimney lining, vent piping changes, propane tank and line installation, gas piping, electrical or ductwork modifications, access improvements, condensate drains, refrigerant lines, or any other HVAC components beyond the furnace. Additional services or upgrades, such as upgrading from 80% to 95% efficiency, can be provided at the homeowner's expense, with a 60% deposit required upfront and the balance due upon substantial completion.

6. Additional Costs:
If the winner requires modifications to the existing furnace system or installation that fall outside of standard equipment replacement, these services will be offered at an additional cost. The prize value is capped at $6,100, and the winner will be responsible for any charges beyond this amount.

7. Selection of Finalists:
Once the team at Vailes reviews all nominations, the top 3 candidates will be selected based on eligibility and need. These finalists will be announced on October 31st, 2024, at 11:00 AM via Facebook, and they will also be contacted through phone calls and emails to confirm details and discuss the next steps. If a finalist does not respond by 11:00 AM on November 4th, 2024, the next eligible candidate will be contacted. Vailes will conduct phone questionnaires with the finalists to further assess their needs. Finalists must be able to be reached by phone. Site visits may be required to verify eligibility, and the top 3 candidates must be available for such visits if necessary.

8. Winner Announcement:
The winner will be announced on or before November 18th, 2024, at 11:00 AM via Vailes' Facebook page, phone call, and email. If the winner declines the prize, it will be awarded to the second-place finalist.

9. Publicity Release:
By accepting the prize, the winner agrees to allow Vailes to use their name, voice, likeness, biography, opinions, and a photograph of them with the furnace for marketing purposes. This includes, but is not limited to, social media, local newspapers, and other promotional materials. The winner must also write a testimonial about their experience with the prize and installation. Vailes may publicize the winner’s name, voice, and likeness, as well as the fact that they won the prize, without additional compensation, unless prohibited by law.

10. Limitation on Liability:
By entering this promotion, each entrant releases Vailes, its parent companies, subsidiaries, affiliates, and their respective directors, officers, employees, and agents from any liability, claims, or causes of action related to participation in the promotion or the use of the prize. This includes, but is not limited to, property damage, loss of life, personal injury, or any other claims arising from or in connection with the prize. Entrants also release Vailes from any claims related to publicity rights, defamation, invasion of privacy, product liability, and merchandise delivery.

11. Sponsor’s Reservation of Rights:
Vailes reserves the right to modify or cancel the promotion at any time. In case of a dispute, Vailes' decisions are final and binding. Vailes reserves the right to disqualify any participant who tampers with the entry process, the website, or violates the official rules. Vailes may cancel, terminate, or modify the promotion if it cannot be completed as planned due to causes such as computer viruses, technical corruption, force majeure, or unauthorized human intervention. Vailes disclaims any warranties regarding the prize, including its merchantability or fitness for a particular purpose.
